What the Fair Housing Act Covers

The Fair Housing Act (FHA) requires housing providers to make reasonable accommodations for qualified individuals with an Emotional Support Animal (ESA). Under federal law, an ESA is not considered a pet.

Because of this distinction, housing providers typically cannot apply pet policies, charge pet deposits or rent, or enforce breed and weight restrictions on a qualified ESA.
